Our office defends homeowners in foreclosure actions, and assists them in attempting to obtain additional time to complete loan modifications, and makes other recommendations depending upon their particular situation. This area of the law has changed greatly in New Jersey in recent times, due to the difficult economic conditions currently prevailing. Because of these conditions, our practice in this area is focused on foreclosure mediation. Robert McGuigan is a court-certified foreclosure mediator.
The purpose of the State of New Jersey's foreclosure mediation program is to help families to remain in their homes and retain ownership when at all possible, as well as to enable mortgage banks to minimize the financial losses resulting from the great volume of defaulted mortgage loans. You can learn about the program at: http://www.nj.gov/foreclosuremediation. The mediation process is one in which both parties work with a court-certified mediator, whose role is to help them find a workable, effective resolution to the problems they face, by being an objective, fair, and insightful facilitator.
In addition to being a Mediator throughout Northern and Central New Jersey, I also represent homeowners as an attorney advocate in this process. Depending on your particular circumstances, you may be eligible to have an attorney appointed to represent you (information available at the above link). However, if you wish to retain your own counsel, we are available to do so.
We represent homeowners in foreclosure mediations throughout the Counties of Northern and Central New Jersey: Bergen, Essex, Hudson, Mercer, Middlesex, Morris, Passaic, Somerset, Sussex, Union, and Warren.
