
Even if you have lost an appeal, the remedy of Post-Conviction Relief
(PCR) may be a beneficial option. Through PCR, one may be able to set aside a
conviction that involved fundamental unfairness or other Constitutional deficiencies.
In this, PCR is similar to the federal court habeas corpus petition. You can
get a clear idea of what is involved in a PCR motion by carefully reading New
Jersey Rule of Court 3.22.
If, after reviewing Rule 3.22, you think that post-conviction relief may be
an option in your case, I would be glad to discuss matters with you, to see if
there is a genuine basis for bringing such a motion. I have had handled many
of these matters, at the trial and appellate levels, and have filed a number
of petitions before the New Jersey Supreme Court.
After the initial consultation, which would be free, a more thorough review
of the record might be necessary. There would be a flat fee for this, but if
after file review we decide to go forward with the petition, that flat fee would
be included in the total. A sliding fee scale applies, and this scale is based
on clients’ financial situations.
